Short answer: To open a Pilates studio in Germany you usually register a trade (Gewerbe), register with the tax office (Finanzamt), confirm with the building authority (Bauamt) that the premises may be used for sport, register the business with the statutory accident insurer (Berufsgenossenschaft) and license music through GEMA. There is no legally required Pilates licence.
This guide is for founders abroad who are considering Germany. It follows the order of the steps and backs each one with an official source, quoting the German briefly with a translation. Building law differs by federal state (Land) and offices assess cases individually, so this is orientation, not advice. Sources last checked: 27 September 2026.
Residence and work permits are not covered here. Non-EU citizens should check those first with the German mission or the local immigration office (Ausländerbehörde).

Do I need to register a trade (Gewerbe) for a Pilates studio?
In most cases, yes. Germany’s federal start-up portal answered exactly this question from a Pilates and fitness trainer: „Tanz-, Sport-, Reit- oder ähnlicher Unterricht und damit auch Tennisunterricht stellen in der Regel eine anzeigepflichtige gewerbsmäßige Tätigkeit dar.“ (“Dance, sports, riding or similar instruction, and therefore also tennis lessons, are as a rule a notifiable commercial activity.”) The reason given: under trade law, teaching only counts as a “higher-level service” if the work requires a university degree.
Tax law can classify the same work differently. The portal notes that only a binding ruling from the tax office („verbindliche Auskunft“) gives certainty about being treated as a freelancer (Freiberufler) for tax purposes. Note that this answer is dated April 2019. It was still online on 27 September 2026, and we found no newer version, so confirm your position with a German tax adviser (Steuerberater).
The registration itself is simple in principle: anyone who wants to run an independent trade must notify the competent trade authority when the activity begins (Existenzgründungsportal: business registration). You then submit the tax registration questionnaire (Fragebogen zur steuerlichen Erfassung) electronically via ELSTER, according to the portal „innerhalb eines Monats nach Betriebseröffnung“ (“within one month of opening the business”).
Can the premises legally be used as a Pilates studio?
Answer this before you sign a lease. The rules come from the building code of each federal state, and the building supervisory authority (Bauaufsichtsbehörde, usually called Bauamt) decides.
The Chamber of Commerce in Cologne (IHK Köln) states the principle for North Rhine-Westphalia: „Grundsätzlich bedarf eine Nutzungsänderung einer Baugenehmigung.“ (“As a rule, a change of use requires a building permit.”) The City of Cologne’s FAQ lists „Kanzlei in Fitnesscenter“ (law office into fitness centre) as an example, and says that if a permitted space is to be used differently, you will “in most cases” need a new permit for the new type of use.
IHK Köln recommends checking two questions before renting or buying: which use is approved for the premises, and whether the planned use is permitted at that location. Even where no permit is needed, public-law requirements still apply. IHK Köln also mentions an amendment to the NRW building code from 1 September 2026 intended to make conversions easier. According to IHK Köln, it does not make changes of use generally permit-free. Ask the Bauamt or a local architect which documents your case requires.
Which insurance and registrations come on top?
- Statutory accident insurance: The VBG, one of Germany’s accident insurers, tells founders to register with the competent Berufsgenossenschaft within one week of opening. Which one is competent depends on the sector. Owners themselves are not compulsorily insured with the VBG; voluntary cover is offered.
- Business and professional liability: IHK Würzburg-Schweinfurt says of business liability insurance: „Auf ihren Abschluss sollten Sie nicht verzichten.“ (“You should not go without it.”) It names a legal obligation only for certain sectors. Ask your insurer to confirm in writing that teaching on equipment such as the Reformer is covered.
- Health insurance: Health insurance has been compulsory for everyone in Germany since January 2009 (SIHK Hagen fact sheet, January 2021).
- Pension insurance: The Deutsche Rentenversicherung counts leading sports and health classes as teaching (DRV notice, 18 Aug 2021). Self-employed teachers without compulsorily insured employees may therefore have to pay pension contributions and must register within three months of starting. Check thresholds and exceptions directly with the DRV.
Do I need a GEMA licence for music in Pilates classes?
Yes, as soon as music is played publicly. GEMA’s page for gyms explicitly mentions training floors, wellness and reception areas. Classes with music fall under tariff WR-KS-F, which covers “playing works from the GEMA repertoire in fitness and health classes with music” (our translation). The current version applies from 1 January 2026. GEMA says the fee depends on three factors: average class size, how often the class runs each week, and what participants pay to attend.
Two points are often missed:
- Royalty-free music: „Ja, auch GEMA freie Musik müssen Sie bei uns anmelden.“ (“Yes, you must register GEMA-free music with us too.”)
- Online classes: GEMA’s help pages say online uses are “usually not covered by existing contracts for on-site music use in the studio” (GEMA help). If you stream classes, clarify that licence separately.
Does the studio owner need a specific Pilates qualification?
Not legally. The German Pilates Association (Deutscher Pilates-Verband, DPV) writes: „Für die Pilates-Ausbildung gibt es keine gesetzlichen Vorschriften.“ (“There are no legal regulations for Pilates training.”) It adds that the name is not protected and that anyone, “with or without training”, can run a Pilates studio.
Commercially, the team’s qualification still shapes safety, teaching quality and retention. If you plan prevention classes subsidised by statutory health insurers under § 20 SGB V, much stricter rules apply to the course leader. Checklist: the order that works
- Define the concept: target group, class formats (Reformer groups, Mat, privates) and pricing. See our business plan guide.
- List the equipment, then look for space: equipment drives floor area and ceiling height. See our brand-neutral equipment list.
- Before the lease: ask the Bauamt which use is approved and apply for a change of use if needed.
- Legal form and tax status: decide with a Steuerberater; request a binding ruling if needed.
- Register the trade when activity begins.
- Tax questionnaire via ELSTER within one month.
- Berufsgenossenschaft within one week of opening; consider voluntary owner cover.
- Liability insurance: get written confirmation that equipment teaching is covered.
- Health and pension insurance: register with the DRV within three months if you are liable.
- GEMA: register class music and background music, including royalty-free music.
- Instructor team: qualification, teaching language and contract type; get legal advice on freelance arrangements.
- Optional: if you plan § 20 SGB V prevention classes, check the ZPP requirements early.
Frequently quoted figures and what they really mean
Studio-launch guides often cite a figure of about 83,000 euros per facility from DSSV, the German fitness employers’ association. The DSSV press release of 18 March 2026 says the industry invested around 798 million euros (net) in 2025, which works out at an average of 83 thousand euros (net) per facility across all facilities. That is an average of annual investment across the whole German fitness industry. It is not a start-up cost and not a Pilates-specific number. Your real costs depend on floor area, fit-out, equipment and staff.
Many guides quote permit processing times or total start-up costs without a source. Ask the competent office directly.
Our advice for planning the studio
These points concern the Pilates side of the project, not German authority procedures:
- Let the equipment define the room. Plan the number of Reformers, spacing, and equipment that needs ceiling height or wall fixing, such as a Tower or Trapeze Table, before you look for premises.
- Think about floors and neighbours early. Jumpboard work and equipment noise matter in buildings with flats or offices. Clarify this before fit-out.
- Get the team ready before the first class. Plan onboarding and a shared teaching standard before opening, not on the side.
- Decide on music deliberately. Many Pilates sessions work well without music. If music is part of the concept, budget for GEMA.

Frequently asked questions
Which permits do I need to open a Pilates studio in Germany? Usually a trade registration and tax registration with the Finanzamt. You also need a building permit if the premises were previously used for something else, registration with the Berufsgenossenschaft, and a GEMA licence if music is played. There is no state Pilates licence. The competent local authorities decide which permits your specific case needs.
How long does it take to open a Pilates studio in Germany? The premises usually set the timeline. If a change of use is required, your start date depends on the Bauamt’s processing time and any building work. Trade and tax registration, by contrast, are formalities with fixed deadlines. Ask your Bauamt about processing times before you announce an opening date.
Can I teach Pilates from my flat? The same trade and tax principles apply as in a studio; the start-up portal answer quoted above covers exactly this case. Under building law, converting a flat to another use can also require a permit: the City of Cologne lists “flat into medical practice” as an example. Also check with your landlord whether commercial teaching is allowed.
Do I need GEMA registration if I only play quiet background music? Yes. GEMA explicitly mentions training floors, wellness and reception areas, and says royalty-free music must be registered as well so the tracks can be checked. For classes with music, the fee depends on class size, frequency and what participants pay. If you teach entirely without music, the class licence does not apply.
Is business liability insurance mandatory? The IHK sources we checked name a general legal obligation only for certain sectors. IHK Würzburg-Schweinfurt is still clear: you should not go without it. Make sure the policy explicitly covers teaching on equipment and errors in instruction, and get that confirmation in writing before your first class.
Do I need to be a Pilates instructor to own a studio? No. According to the German Pilates Association, anyone can run a Pilates studio “with or without training”.
